### Terms & Conditions of Aabishkar Travels ###
**Purpose of the Agreement:**
This agreement ("User Agreement") outlines the terms and conditions for **Aabishkar Travels Pvt. Ltd** and its affiliated companies ("Aabishkar Travels") to provide services to the person(s) ("the User") intending to purchase or inquire about any products and/or services of Aabishkar Travels by using Aabishkar Travels' websites or any other customer interface channels, including its offices, call centers, salespersons, advertisements, and information campaigns.

**User's Responsibility to Acknowledge this Agreement:**
Users availing services from **Aabishkar Travels** are deemed to have read, understood, and expressly accepted the terms and conditions of this agreement. This document governs the transactions or services provided by Aabishkar Travels for all purposes and shall be binding on the User. All rights and liabilities of the User and/or Aabishkar Travels with respect to any services to be provided by Aabishkar Travels are limited to the scope of this agreement.
**Aabishkar Travels** reserves the right, at its discretion, to terminate access to any or all of its websites or other sales channels without prior notice, for reasons such as maintenance or other unforeseen circumstances.
Additionally, there are specific Terms of Service (TOS) for the services rendered or products provided by **Aabishkar Travels**, such as air tickets, road transportation, rail, holiday packages, etc. These TOS will be updated by Aabishkar Travels and will be considered part of this agreement. In the event of a conflict between such TOS and this agreement, the terms of this agreement shall prevail. The User must read and accept the relevant TOS for each service/product availed.
Service providers may also have their own terms, conditions, and guidelines. The User must ensure compliance with these terms, guidelines, or operating rules of the Service Provider, including those found in fare rules, contracts of carriage, or other policies.
**Aabishkar Travels** services are offered on the condition of acceptance, without modification, of all the terms, conditions, and notices in this agreement. If the User does not agree with any part of these terms, they should refrain from using Aabishkar Travels services.
In cases where any term, condition, or notice in this agreement contradicts with other terms or guidelines provided by **Aabishkar Travels**, the terms of this agreement shall prevail.

**Third-Party Account Information:**
By using the account access service on **Aabishkar Travels** websites, the User authorizes **Aabishkar Travels** and its agents to access third-party sites, such as banks, financial institutions, and payment gateways, to retrieve information as required. When registering as a member, the User will choose a password and is responsible for maintaining its confidentiality.
The User is responsible for all activities under their account and must notify **Aabishkar Travels** immediately of any unauthorized use. **Aabishkar Travels** is not liable for any losses or damages caused by unauthorized use of the account, with or without the User's knowledge. The User must not use anyone else's password.

**Payment of Service Fees:**
**Aabishkar Travels** reserves the right to charge transaction or listing fees based on certain completed transactions. These fees may change without notice. The User is responsible for all applicable charges, fees, taxes, duties, and other assessments.
If a reservation is not confirmed for any reason, **Aabishkar Travels** will process a refund but is not obligated to make another booking in lieu of the unconfirmed one. Each subsequent booking is treated as a new transaction.
For refunds on unutilized air tickets, hotel bookings, or no-show events, the User must request a refund within 90 days of the departure/check-in date. Refunds will be processed according to the policies of the respective airlines, hotels, or **Aabishkar Travels**. Refund requests after 90 days will not be entertained.

**Confidentiality:**
Any information deemed confidential by **Aabishkar Travels** must be maintained as such by the User, except where disclosure is required by law or necessary for the execution of this agreement.

**Use of User’s Mobile Number:**
**Aabishkar Travels** may send itinerary information, booking confirmation, payment confirmation, cancellation, refund status, or other relevant information via SMS or voice calls to the contact number provided by the User. These communications are considered:
A. Transactional and not unsolicited commercial communication as per the guidelines of Nepal Telecommunications Authority (NTA);
B. Requested and authorized by the User;
C. Compliant with relevant guidelines of the NTA or other authorities.
The User will indemnify **Aabishkar Travels** against any losses or damages resulting from complaints raised by the User to the NTA or other authorities regarding the communications.

**Proof of User Responsibility:**
**Aabishkar Travels** is responsible only for the transactions done through its platform. It is not liable for ensuring the legality of any transaction. The User agrees to comply with all applicable laws, regulations, and guidelines.
The User represents that they are of legal age to enter into a binding contract and are not barred from availing the services under the laws of Nepal or other applicable jurisdictions.

**Force Majeure Events:**
There may be exceptional circumstances, such as adverse weather, strikes, government actions, or operational issues, where service providers like airlines or hotels cannot honor confirmed bookings. In these cases, **Aabishkar Travels** will refund the booking amount, less applicable service charges, but is not liable for compensating the User for the unconfirmed bookings.
**Aabishkar Travels** shall not be held liable for delays, failures, or other circumstances beyond its control, including acts of God, terrorism, or transportation-related issues.

**Data Download Risks:**
The User agrees that any data downloaded from **Aabishkar Travels** is done at their own risk, and **Aabishkar Travels** is not liable for any damage to computer systems or loss of data.

**Insurance:**
Obtaining sufficient insurance coverage is the responsibility of the User unless explicitly provided by **Aabishkar Travels** as part of the service. **Aabishkar Travels** is not liable for any claims related to insurance.

**Intellectual Property:**
Content provided by **Aabishkar Travels** such as photographs, videos, or other material may be protected by copyrights and trademarks. Users may not reproduce or distribute such content without explicit permission.

**Visa Obligations:**
Travel bookings are subject to applicable visa requirements. **Aabishkar Travels** is not responsible for any issues arising from visa requirements, including the inability to travel.

**Right to Refuse Service:**
**Aabishkar Travels** reserves the right to refuse any customer order without reason. No contract for services is considered complete until full payment is received.
If **Aabishkar Travels** has reason to believe that any information provided by the User is incorrect or unauthorized, it reserves the right to cancel the booking without prior notice.

**Severability:**
If any provision of this agreement is found invalid or unenforceable, it will not affect the validity of the remaining provisions.
